Terms of sale

These terms govern every watch and every service sold by Lindenaer. Placing an order means you accept them. Who we are is set out on the legal page.

Prices

Prices are in euro and include Italian VAT. Shipping and any duty or import tax outside the European Union are charged separately and are yours to pay. A price holds only until we accept an order, and we may change prices at any time before that.

Orders

An order or an application is an offer to buy. It binds nothing until we accept it in writing. We may decline any order or application, and we do not have to give a reason. Where a watch is one of one, we may decline before or after reading what you have written.

Payment

Watches are paid in full before dispatch. A commission is paid in full before work begins, because the artwork is made for you and cannot be sold to anyone else. The watch remains ours until we have been paid in full.

Delivery

We deliver within the time agreed when we accept your order. Unless we agree otherwise, that is eight weeks for a commission and thirty days for a watch bought ready made. Risk passes to you when the watch is delivered to you or to someone you name.

Right of withdrawal

Watches bought ready made

If you are a consumer in the European Union you may withdraw from the purchase of a watch bought ready made from the Collection within fourteen days of receiving it, without giving a reason. Tell us at atelier@lindenaer.com within that period and send the watch back within fourteen days of telling us.

The cost of returning the watch is yours. Send it insured and tracked: until it reaches us it is at your risk. The watch must come back complete, unworn and in its packaging. You are liable for any loss in value caused by handling it beyond what is needed to see what it is.

We refund what you paid, including the cheapest standard delivery we offer, within fourteen days of the watch reaching us. We may hold the refund until we have the watch back or you have shown us it was sent.

One of one commissions

There is no right of withdrawal on a commission. The artwork is made from what you write, for your watch, and is never made again, so it is a good made to your specification and clearly personalised. Article 59 of the Italian Consumer Code and Article 16 of Directive 2011/83/EU exclude the right of withdrawal for such goods. You are told this before you order and you confirm it when you apply. Once we accept your application, you cannot cancel.

Guarantee

If you are a consumer you have the legal guarantee of conformity under the Italian Consumer Code for two years from delivery. Nothing here limits it.

On top of it we give a commercial warranty of four years from the year the watch was finished, extended to five if we service the watch in its fifth year. The warranty covers faults in our work, in the movement and in the artwork on the dial, under normal use. The strap is covered for one year. It does not cover fair wear, scratches, water beyond the stated five ATM, accident, misuse, or any watch opened or worked on by someone other than us. The warranty goes with the watch where the new owner registers it with us within thirty days of the sale, and runs from the year the watch was finished either way. None of this touches the legal guarantee. It is set out in full on the warranty page.

Editions

The number of watches in an edition is fixed when the edition opens and is never increased. The artwork on a dial is drawn for that watch and for nothing else. We do not reuse it, reprint it or licence it, and we do not make a second watch from it.

The artwork

Buying a watch buys the watch. Every right in the artwork on the dial, in the drawings behind it, and in the name Lindenaer stays with us. You may not reproduce the artwork commercially.

A one of one is never shown. We do not photograph it for publication, we do not put it on this site, and we do not share its artwork anywhere, ever. The copyright is ours and it stays unused. A watch from a limited edition we may photograph and show.

What you write

We read what you send us in an application, and we make the artwork from it. It is used for nothing else and we do not publish it. How we handle it is set out in the privacy policy.

Liability

We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Subject to that, our liability arising from a sale is limited to the amount you paid for it, and we are not liable for indirect or consequential loss.

Law and disputes

Italian law applies. If you are a consumer you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings in the courts where you live. You may also put a dispute to an approved alternative dispute resolution body.
